Letecia Stauch’s overturned murder conviction appealed to the state Supreme Court

EL PASO COUNTY, Colo. (KRDO) -- An appeal has been filed with the Colorado Supreme Court in the murder case against Letecia Stauch.

The Colorado Department of Law confirmed it filed an appeal with the Supreme Court on June 29 and is waiting to hear if the court will review the case.

Stauch's conviction was overturned in April of this year by the Colorado Court of Appeals. According to court records, Stauch appealed her conviction after arguing, in part, that the trial court made an error by denying her a challenge to a juror whose son-in-law worked in the same office that was prosecuting her case.

Stauch was originally found guilty of murdering her 11-year-old stepson, Gannon Stauch in May of 2023. At the time, Stauch was sentenced to two life sentences without parole for first-degree murder and first-degree murder of a child under 12 by a person in a position of trust.

She was also convicted of tampering with a deceased human body and tampering with physical evidence.

Gannon Stauch was first reported missing from his Lorson Ranch home on Jan. 27, 2020. His stepmother, Stauch, was arrested in early March 2020 for his death. Later that month, on March 17, 2020, his body was found stuffed in a suitcase under a bridge in Florida. According to the autopsy, he had been shot, stabbed, and had a skull fracture.

The defense in Stauch's original trial admitted she had committed the crime but she had "no idea" what she was doing. Stauch had previously been given two competency evaluations in regards to the trial.

Stauch remains in custody with the Colorado Department of Corrections (CDOC) at the Denver Women's Correctional Facility and would remain there for the time being, according to the CDOC in April.
