Woodland Park Police: Man arrested for sexual assault on a 7-year-old child

WOODLAND PARK, Colo. (KRDO) -- A 33-year-old man faces numerous charges and is accused of sexually assaulting his best friend's youngest daughter.

Thursday, June 30, Kevin Edward McAvoy Jr. was arrested on probable cause concerning unlawful sexual conduct with a 7-year-old child.

According to the Woodland Park Police Department, McAvoy faces the following charges:

• Sexual Assault on a Child - (Felony 4)
• Indecent Exposure - (Misdemeanor 1)
• Unlawful Sexual Contact w/Minor - (Misdemeanor 1)
• Child Abuse (Misdemeanor 2)

According to the arrest affidavit, a woman and her 7-year-old daughter came into the Woodland Park Police Department on June 15, 2022, to report a Sexual Assault on a Child.

The mother told investigators that she was separated from her husband, William Haggett, and he was staying with his best friend, identified as McAvoy.

According to the affidavit, the child told investigators while at McAvoy's house on Saturday, June 11, 2022, for visitation with her father, McAvoy used her bare feet to masturbate.

The affidavit indicates the mother and her estranged husband have three children together who have been spending the last few weekends at McAvoy's Woodland Park home.

McAvoy's elderly father, Kevin P. McAvoy, also lives in the home.

According to the affidavit, Haggett has known McAvoy since they were both children. The mother told investigators their children call him "Uncle Kevin." However, McAvoy is not related to them, just a close family friend.

When speaking with investigators, the child told police McAvoy told her "not to tell anyone." When asked if she knew why she was at the police station, she stated, "because Uncle Kevin made my feet touch" him. She went on to tell officers she "lied" to McAvoy and ended up telling her mother.

The affidavit says a Safe Passage interview happened on Friday, June 24, 2022, with Stephany Rhodes, a Forensic Interviewer. While this interview happened, a Teller County Victim Advocate (TCVA) and a Woodland Park Police Department investigator watched in a remote viewing room.

During that interview, the affidavit says the victim detailed what happened to her. The victim initially went into McAvoy's room to hand him his phone and play video games. She told Rhodes her father was not in the room, he was packing their things up to go back to her mother's home.

At that point, the affidavit states McAvoy got up, closed, and locked the door. The victim described in detail how McAvoy looked after he pulled down his pants, took off her socks, and picked up her feet.

In the affidavit, the child said she told McAvoy, "no, no, no, no, no, no, no, no, no!" In response, McAvoy told her to "shush."

The victim told Rhodes she wasn't sure why McAvoy stopped but said eventually she was able to open the door and walk out. The affidavit states nobody else saw what happened.

According to the affidavit, Haggett told police he was with his other two children in another room while McAvoy was with the victim in his bedroom. Haggett said it was not "unusual" for her to be in McAvoy's bedroom. He went on to say he remembered his youngest daughter coming down the hall crying because "she tried to get into McAvoy's room to play and was told she could not come in."

McAvoy is being held on "No Bond" at the Teller County Jail.
