Colorado Springs doctor who wanted sex with 14-year-old gets probation

A doctor in Colorado Springs who was arrested for wanting sex with a 14-year-old boy avoided jail time at his sentencing this week.

Kyle Akers, 62, was sentenced Tuesday to five years of sex offender intensive supervised probation after pleading guilty to attempted sexual assault of a child in September.

Akers was arrested as part of a large online sex sting called Operation Broken Heart, and he faces a charge of attempted sexual assault on a child. A total of 88 suspects were arrested across the state, and 23 of them were arrested by Colorado Springs police.

Online records state that Akers was an occupational medicine doctor who practices in Colorado Springs. 

According to an arrest affidavit obtained by KRDO, Akers was also married at the time that he started messaging an undercover officer posing as a man with a 14-year-old boy on the dating app Grindr.

The investigation started on April 9, when the undercover officer created the profile on Grindr with a description that said "Into Taboo life, poz and?". The word "poz" indicates that the person is HIV positive.

At about 2:45 p.m. that day, the undercover officer got a message from a user later identified to be Akers saying, "Talk to me about taboo."

At that point, the undercover officer asked Akers "how young have you gone." The officer got a response saying, "15 so far, met a guy who did 4." Akers admitted in a message that he was actively looking for someone, police say.

The officer sent a message saying he had a 14-year-old boy that he was going to meet with for sexual acts, and Akers asked if he could watch and pleasure himself, the court documents state. The undercover officer then offered to let Akers have sex with a 14-year-old boy, and Akers said he would. The officer again asked if that was OK, specifically saying, "I feel like I pressured you into sex, u cool he is 14?"

According to the affidavit, Akers replied, "yep." He then identified himself as a "55-year-old doctor" and said he would meet the minor at a building in downtown Colorado Springs. He said he would be wearing green pants with a red and green Hawaiian shirt.

At about 5 p.m., Akers arrived at the building wearing light green pants and a red and green Hawaiian shirt. He was taken into custody and was found with a condom and erectile dysfunction medication in his pocket, according to the affidavit.

Police conducted an interview with Akers, and he admitted to communicating on Grindr and confirmed his username. He also confirmed chatting about having sex with a 14-year-old boy but said it was all "fantasy chat," according to the affidavit. An investigator asked Akers why he walked to the building to meet the minor for sex, and Akers said he was there to "see if the person he was talking to was real."

Akers claimed that if there was a minor, he wouldn't have engaged in sexual intercourse and would have left. He claimed that he "always keeps a condom and erectile dysfunction medication with him."

Akers will also have to pay more than $4,000 in fees and surcharges.
