Man admits to killing grandfather at McDonald’s in Colorado

The man accused of killing his grandfather at a McDonald’s in Canon City could be facing anywhere from 16 to 32 years in prison.

Zebulon Montgomery, 25, pleaded guilty on Tuesday to shooting his grandfather, 62-year-old Kelly Ray Smith, according to our partners at The Pueblo Chieftain.

A plea agreement for a charge of second-degree murder is expected to result in somewhere between 16 and 32 years in prison, Assistant District Attorney Thom LeDoux said.

On August 13, 2017, law enforcement responded to the McDonald’s located at 2305 Fremont Drive at around 6:30 p.m. and found the body of Kelly Ray Smith. A nearby security camera captured Montgomery and Ray inside a pickup truck in the McDonald’s parking lot just after buying food. As Smith was pulling into a parking spot, the footage shows Montgomery shoot him in the head.

Montgomery was arrested a short time later at a nearby church with a .380-caliber semi-automatic handgun in his pocket.

He remains in jail on a $100,000 cash-only bail, according to the Chieftain. He will be sentenced on April 17.
