Toddler Shot in Both Legs now Recovering at Home
The toddler who was shot inside a Colorado Springs apartment complex just returned home from the hospital today.
One-year-old Carlos is still recovering after a bullet went through both of his legs. Part of his left leg now broken with a cast on it. He will have to go to physical therapy and his family says doctors are not sure if he will ever be able to walk.
The bullet went through his parent’s bedroom. They say Carlos was standing on the bed frame when the bullet penetrated the wall and into Carlos’ legs Tuesday night. Blood still visible on the sheets from the night it happened. His parents say if he was standing next to the bed instead, this shooting could have turned deadly.
After the shot was fired, the parents say the suspect, 26-year-old Jair Isaza and his girlfriend ran over to their apartment to see if anyone was hurt. He was taken into custody that same night.
Since Isaza is a convicted felon, local criminal attorney Jeremy Loew says he should not have had a gun in his possession even if it was an accidental shooting. “The gun misfired but that doesn’t discount the fact that he wasn’t allowed to have a gun in the first place,” Loew says.
However, according to the arrest affidavit, it says Isaza bought the gun for protection, which has been used by defense attorneys in the past to clear charges. Loew says, “He’s allowed to have a gun if he is in fear of his life or safety and that’s an immediate fear of safety.” Since the gun was purchased in December, Loew says the suspect did not appear in immediate danger and could face up to 12 years behind bars.
