Pothole problems: Truck driver stuck in Springs
A truck driver says he’s stuck in Colorado Springs because a pothole damaged his semitrailer truck.
While traveling through Colorado Springs on Easter, Ron Middleton says he struck a pothole on the corner of Commerce Street and Nevada Avenue.
Middleton says the impact was bad enough to shear one of the semi-truck’s leaf springs in half.
The truck is being repaired in Colorado Springs. It will cost the driver around $1,700.
Middleton has filed a claim with the city.
The city is looking into this case and determining if the pothole is on a public right of way or a private road/driveway.
The Governmental Immunity Act states that the city must be notified of a pothole and be allowed a reasonable time to repair it before the city would be liable. A reasonable time period to repair is dependent on weather and resources.
The city encourages residents to report potholes along their commute so that it can get them repaired..
Residents who believe their vehicles have been damaged from a pothole may file a claim with the city by calling 385-ROAD. Be sure to provide the names of cross streets and exact street address, if possible.
The city usually processes claims within 5-7 business days. If there is no claim payout for damage and the person wants to file a claim with their insurance, they will likely need the proof of claim from the city.
