Lawsuit filed by survivors of Club Q shooting dismissed by federal appeals court

EL PASO COUNTY, Colo. (KRDO) -- A federal court has dismissed a lawsuit filed by survivors of the Club Q shooting.

The lawsuit was filed against the club's owners and El Paso County officials in 2024, two years after the shooting happened. According to the lawsuit, the victims believed the shooting could have been prevented.

The lawsuit alleged the club's owners and county officials didn't take reasonable precautions to prevent the shooting, pointing to escalating threats against LGBTQ spaces across the country. It also claims the El Paso County Sheriff's Office failed to use Colorado's red flag law, allowing the shooter to get the weapons for the attack.

The lawsuit claimed the club's ownership didn't provide enough security for the venue.

The lawsuit was partially dismissed by a state court in 2025. The latest ruling is from a federal appeals court, which means the plaintiffs would have to appeal the case to the Supreme Court if they wanted to continue.
