Frazee hires Colorado Springs defense attorney to represent him for civil suit

Patrick Frazee has officially hired the firm of Farry & Stock, P.C to represent him in the wrongful death civil lawsuit filed against him by the Berreth family.

Farry & Stock, P.C focs on both both criminal and civil cases.

You may remember the suit accuses Frazee of wrongful death, negligence, conspiracy, and infliction of emotional distress.

The KRDO team sat down with a legal expert, attorney David McDivitt, who explained it’s not likely this suit will move forward until the criminal case wraps up.

“When the criminal case concludes, that’s when the floodgates open and that defendant can no longer plead the 5th Amendment,” said McDivitt.

This means once charged in the criminal case, Frazee will be required to respond to all accusations truthfully and attend a deposition.

“It’s typically a one-to-one interview with the attorneys with the plaintiffs, and the defendant is required to answer questions under oath,” McDivitt said.

But until that point, Frazee has to respond first.

“It seems likely that Frazee may plead to Fifth and refuse to answer any of the questions or refuse to answer any of the allegations that are in the complaint,” McDivitt said.

That being the most likely option, given anything Frazee does say could be used against him in the criminal case.

Frazee has until Jan. 29th to make a formal response.
