Colorado man gets 32 years in prison for killing grandfather

A 25-year-old Colorado man has been sentenced to 32 years in prison for fatally shooting his grandfather in a McDonald’s parking lot.

The Pueblo Chieftain reports that Zebulon Montgomery was sentenced on Tuesday after pleading guilty to second-degree murder in the shooting of 62-year-old Kelly Ray Smith.

The incident occurred as the two were inside a truck in the restaurant parking lot following a purchase at the drive-through. Video surveillance footage obtained by police showed Smith was driving, pulling slowly into a parking space, when Montgomery shot him in the head.

Montgomery’s attorney, public defender Alexandra Roback, did not make a plea for leniency for her client. But Roback pointed out that Montgomery had fetal exposure to drugs and alcohol, which could have led to his inability to foresee consequences.
