Child sex offender set free on technicality arrested in Colorado Springs

A man who was serving prison time for child sex crimes but was released due to a technicality was arrested in Colorado Springs on Friday.

Michael Tracy McFadden, 46, was convicted of 19 counts of child sex offenses back in 2015 and was supposed to serve 300 years at the Arkansas Valley Correctional Facility until the Colorado Court of Appeals determined that McFadden’s rights were violated when the judge in the case granted a continuance. His case was thrown out.

McFadden was released on Tuesday and then was back behind bars two days later for failure to register as a sex offender in connection with an incident unrelated to his 2015 conviction.

McFadden will be booked into the El Paso County Criminal Justice Center.
