Daniel Nations gets 3 years probation for menacing in El Paso County
The man accused of threatening people with a hatchet in the Monument area has been given three years supervised probation.
Daniel Nations accepted a plea deal and was charged with menacing and possession of a weapon by a previous offender Friday in El Paso County court. One charge of menacing and a charge of trespassing were dropped.
This comes after Nations threatened at least one person with a hatchet along Mount Herman Road in Monument, Colo. in September of 2017. Nations of Indiana claimed in court Friday that he was diagnosed with PTSD and severe anxiety disorder in 2016 from his time in the Marine Corps and was getting treatment until May of 2017. That’s when he came to Colorado after hearing of his brother’s death.
Edward Eugene Lyles, 39, was assaulted and died from his injuries in January of 2017.
While in Colorado, Nations, his wife, and his three kids were living out of their car. At one point, someone broke into it, and they felt stuck in Colorado. Nations blamed these misfortunes for his irrational behavior with the hatchet and told the judge that he just wanted his children back.
Because of living conditions, Nations’ kids are currently being held in DHS custody.
The judge ordered Nations to three years of supervised probation and required him to get a mental health and substance abuse evaluation. If he breaks his probation, he will automatically spend two years in prison.
Nations is currently still behind bars because of a warrant out of Clear Creek County, Colo.
He also continues to be a person of interest in the murder of two girls in Delphi, Ind.
