Judge agrees to toss 2 of 9 counts against Terry Maketa
The judge overseeing the trial against the former sheriff of El Paso County said in court Wednesday that he will agree to toss out two of the charges against Terry Maketa.
Last week, prosecutors requested that the charges of kidnapping and false imprisonment be dropped.
The decision comes as prosecutors and defense attorneys continue to question potential jurors.
This wasn’t the only major development to unravel since questioning began on Tuesday.
It was also brought to the judge’s attention that an attempted murder charge was on all of the potential jurors’ questionnaires.
Maketa’s attorney David Kaplan requested that the judge starts over on jury selection, but the judge refused.

Maketa was indicted on nine charges last year, including official misconduct and witness intimidation.
