DA’s office declines to pursue charges in deadly road rage shooting

The 4th Judicial District Attorney’s office says it does not plan to file charges in a deadly road rage-related shooting that happened in Colorado Springs on July 17.

Jesse Garcia, 23, died after being shot in the parking lot of a Taco Bell restaurant in the 1500 block of S. Nevada Avenue, south of downtown.

Colorado Springs Police investigated the shooting and the district attorney’s office reviewed the investigation.

According to the DA’s office, investigators found that a man named Jack Rogers was driving to the Taco Bell to get some food when he noticed a white vehicle tailgating him.

The police report says that the white vehicle followed Rogers as he pulled into the parking lot behind Taco Bell and a Kentucky Fried Chicken next door. It says Garcia pulled into a nearby parking space, got out of his car, and walked up to Rogers’ car.

According to police, Garcia lunged through Rogers’ car window and hit him as Rogers was trying to call 911. They say Rogers had a gun in his car, and that the gun went off as the two were wrestling for it.

Surveillance video showed Garcia lunge into Rogers’ vehicle and then falling to the ground when he was shot. The video has not been released.

Rogers suffered a bruise underneath and around his left eye, a scrape to the bridge of his nose and pain to his upper chest/collarbone area.

After reviewing the evidence, the district attorney’s office concluded that based on the information available and current Colorado law, no charges will be filed.
