Attorneys want court to prohibit Dear from speaking to the media

Attorneys for accused Planned Parenthood shooter Robert Dear have filed a motion to prevent their client from talking to reporters.

In the motion, which was filed on July 22, Dear’s lawyers ask Judge Gilbert Martinez to order the Colorado Mental Health Institute at Pueblo to prohibit Dear from communicating with members of the media.

Dear was ruled mentally incompetent on May 11, which his lawyers say proves that he is not able to make good decisions for himself. The motion reads in part: “In other words, Mr. Dear’s mental illness is preventing him from making rational decisions about how to proceed in his case. This includes his decision to speak to the news media, which has the potential to profoundly impact his state and federal constitutional rights to due process and a fair trial.”

The attorneys noted in the motion that Dear has spoken to several reporters in the past, including KRDO NewsChannel 13’s Heather Skold. They say that they were informed last week that Dear is continuing to communicate with the media while he is receiving treatment at CMHIP.

Dear is charged with 179 counts, including murder, attempted murder and assault, in the Nov. 27 shootings at the Colorado Springs clinic. Nine people were injured. Ke’Arre Stewart, 29, Jennifer Markovsky, 35, and UCCS Police Officer Garrett Swasey died in the attack
