Holmes’ secret location could challenge civil suit
One of the attorneys who prosecuted Aurora theater shooter James Holmes says both sides in the civil case face challenges because Holmes’ location is being kept a secret.
Because the Colorado Department of Corrections will not disclose where Holmes is being housed, neither side will get to call him as a witness, write him a letter or travel to depose him. The DOC moved Holmes after he was injured by another inmate at a prison in Canon City.
But keeping his location quiet is strange to Rich Orman, Senior Deputy District Attorney with the 18th Judicial District.
“I mean, you can go to the federal inmate locator website and find out where anybody is, the Uni-bomber. California doesn’t keep it a secret where Charles Manson is, so I do think that it’s a little unusual,” Orman said.
He added that it is also frustrating for the families of the victims because they don’t know his privileges, security status or the escape risk at his facility.
