Supreme court seeks answers

tonight, the chief judge of el paso county has 20 days to explain why he won’t release court records in the robert dear case. the colorado supreme court is forcing the judge to explain why he’s keeping that information from you … it comes one day after the admitted planned parenthood shooter was moved to state meantal health institute in pueblo for a mental evaluation. krdo newschannel 13’s greg miller is live at the el paso county courthouse tonight. greg, it’s unusual for a case to be sealed like this. james and heather, the attorney representing 25 media organizations, including krdo, filed the motions to get these documents unsealed. he says while the arrest records serve as public interest, and he’s afraid the court’s actions will set a dangerous precedent. dear: do you know who this lawyer is? he’s the lawyer for the batman shooter who drugged them all up and that’s what they want to do to me. courtroom outbursts are all we know about admitted planned parenthood shooter robert dear. something that’s not okay with attorney steven zansberg. once an arrest warrant has been issued and the defendant is formally charged, they records are unsealed. that’s pretty typical. court papers that are typically open to the public after a preliminary hearing remain sealed. so zansberg asked the colorado supreme court for the records … or at least clarification. greg: we contacted chief judge martinez but his office told me he couldn’t comment on the process mentioned or the supreme court’s actions. but another attorney tells me for those documents to remain sealed, is unheard of. loew 1:50: i’ve never seen a case where an entire arrest affadavit has been sealed. attorney jeremy loew says if the court can justify why those records threaten the judicial process, martinez’s ruling could be upheld. but it’s not easy. with the ability to redact and essentially keep out pertinent information, it’d be difficult to have the whole thing sealed. whether we will see those records – now depends on the state’s highest court. if the court rules martinez can’t justify sealing the records – we should see them within the next twenty days. live in cs, gm, nc 13. difficult to have the whole thing sealed. whether we will see those records – now depends on the state’s highest court. if the court rules martinez can’t justify sealing the records – we should see them within the next twenty days. live in cs, gm, nc 13. new
