Marijuana lawsuit against Pueblo County dismissed

Pueblo County and the State of Colorado were dismissed of all counts in a Federal Preemption and Racketeer Influenced and Corrupt Organizations (RICO) case that challenged the legality of Amendment 64 Tuesday.

“We are extremely pleased the court ruled in our favor. The result of the case is upholding the will of the people which is what government should always be about,” Pueblo County Commissioner Terry Hart said in a county press release.

Pueblo County said the case cost tax payers more than $100,000 in attorney’s fees.

On February 19, 2015, the Safe Streets Alliance filed the case against nine private sector entities, several state entities, the Pueblo County Board of County Commissioners, as well as the Pueblo County Liquor and Marijuana Licensing Board. Pueblo County’s motion to dismiss the case was filed on April 30, 2015.
