Suspect in Black Forest killing captured in Denver

The El Paso County Sheriff’s Office says a man it suspects of shooting two people in Black Forest Friday morning has been arrested in Denver.

FBI agents arrested Maxwell Garihan, 59, at around 8 p.m. Friday. Garihan is accused of shooting and killing Alan Havens, 57.

Garihan is also accused of shooting his estranged wife. She was taken to the hospital and underwent surgery. A dog was also shot. Both are expected to recover.

The shooting happened shortly after 12 a.m. in the 4100 block of Bobbie Kay Place, at a mobile home the couple once shared.

Garihan and his wife had been married around a year and separated this spring, according to an earlier report.

Court records show the couple began divorce proceedings on Sept. 14, the same day Garihan’s wife filed a protection order against him. A judge issued the order Sept. 25. A divorce hearing was held earlier this week, and the next was scheduled for Oct. 26.

Documents for the protection order show Garihan left his wife more than 80 threatening messages via emailing, texts and handwritten notes such as, “Til death do us part” and “If I can’t have you, no one will”.

Garihan faces charges of first-degree murder and attempted first-degree murder. His criminal past includes arrests for menacing, assault, obstructing a peace officer, disorderly conduct, criminal mischief and burglary.
