#HolmesTrial: Aurora Theater shooter to be formally sentenced

The man convicted of killing twelve people at an Aurora movie theater in 2012 will be formally sentenced Monday.

Earlier this month, jurors could not reach an agreement on sentencing shooter James Holmes to death row, so he will spend the rest of his life in prison without the possibility of parole.

Holmes killed 12 and injured 70 during the premier of “The Dark Knight Rises” at an Aurora movie theater. He was found him guilty on all 165 counts.

On Monday, Holmes will find out his sentence on 140 attempted murder counts. People who survived the shooting and loved ones of those who did not are expected to testify during the three days of the sentencing hearing.

Attorney Shimon Kohn said there is no chance Holmes could get the death penalty. He said Holmes could be sentenced to more than a thousand years in prison.

“He will never be able to serve for the full amount of time he was sentenced for in this case,” said Kohn.

Florence residents Caleb and Katie Medley will testify Monday. Caleb was shot in face and suffered severe brain injuries. Katie was nine months pregnant at the time of the attack. She gave birth to their first child a few days after the shooting in the same hospital where Caleb was in critical condition in a medically induced coma.

Caleb’s father, Otis Medley, wants Holmes sentenced to death. He said he did not have expectations for Monday’s sentencing hearing.

“I don’t have high hopes for any kind of change of any kind. They have already decided against the death penalty, so what else is there to be done?” said Otis.

He said he is looking forward to the end of the trial.

“I don’t care about him. I don’t care if I ever hear this name again,” said Otis.

The sentencing hearing is expected to wrap up on Wednesday.
