Dad files lawsuit against Dylan Redwine’s mom, claims her actions led to his death

The father of a murdered teen who was named a person of interest in his son’s death Wednesday has filed a lawsuit against the boy’s mother blaming her for his death.

Dylan Redwine, who lived with his mother in Monument, disappeared in November 2012 while visiting his father, Mark Redwine, in Vallecito over the Thanksgiving break. His remains were found on a mountain near his father’s home in June 2013. He was 13-years-old.

Redwine’s cause of death was originally listed as undetermined, but the La Plata County Coroner has changed his cause of death to homicide. Mark Redwine was named a person of interest on Wednesday.

Dylan’s mom, Elaine Hall, filed a wrongful death lawsuit against Redwine on June 29. In the lawsuit, Elaine Hall alleges her ex-husband’s conduct resulted in the death of their son and that Dylan’s death was “the proximate and direct result of the negligence” of Mark Redwine.

Mark Redwine’s counterclaim, which was filed in La Plata County District Court, accuses Elaine Hall of leading a “concerted campaign” to blame him for their son’s death and of pursuing a “campaign to influence law enforcement to treat Mark Redwine as a suspect — the only suspect — in his son’s death.”

The suit also reads in part “while Dylan’s cause of death is not known and may never be known, it is more likely than not that he left Mark Redwine’s home during the Thanksgiving break 2012, possibly encouraged by Elaine Redwine and met with whoever or whatever caused his death.” The suit goes on to claim that Dylan Redwine would still be alive were it not for his mother’s actions.

In the suit, Mark Redwine asks for Elaine’s lawsuit against him to be dismissed, financial compensation and for his attorney’s fees to be paid.
