Phase three of Holmes Sentencing starts Tuesday

shooter james holmes may be sentenced to death. a jury decided to move on to the next phase of sentencing today. jurors ruled the defense’s case was not strong enough to eliminate the death penalty as an option. the third and final phase will begin tomorrow. families will testify about the impact of the 2012 attack on their lives. those families say they want the trial to end so they can put this behind them… a legal expert is making a bold prediction about the shooter’s fate. krdo newschannel 13’s greg miller was at the courthouse today and talked with survivors. he joins us live in studio … greg. james and rana today’s decision by the jury doesn’t necessarily mean they’re learning towards or against the death penalty simply that the evidence wasn’t strong enough to eliminate it as a possibility. some family say they want the shooter to die…but one attorney says that’s not likely. 29:38 the answer is yes. some family of those killed in the aurora theater shooting admit – they’d like to see the death penalty. 1:59 i believe the death penalty phase is the proper penalty for this, and that’s a very hard decision to make. i’m a very religious person. 05:12 i’ve always been against the death penalty, but hearing the testimony, hearing the witnesses, seeing the disregard for life, having no remorse, no compassion, there are some people that should get the death sentence. but one attorney, who has tried more than 30 death penalty cases – thinks holmes will live. 2:39 the public defenders representing him are in fact some of the most skilled defense attorneys in the country, very well experienced in the death penalty. they picked a jury specifically for this next phase. attorney david lane says it will only take one juror to alter the shooter’s fate 1:25 the death of twelve people is huge, the weight of the tombstone will always outweight anything the defense could put out. 3:00 sentencing someone to death when there’s that level of mental illness is just something they’re not going to do. while the family members who came forward today admit they want to see the shooter die – 2:20 even if the jury decides to do life in prison or the death penalty phase, i believe i’ll be happy with either decision they hope when the trial ends… they can finally move on. prosecutors say even if the jury decides to do life in prison or the death huge, the weight of the tombstone will always outweight anything the defense could put out. 3:00 sentencing someone to death when there’s that level of mental illness is just something they’re not going to do. while the family members who came forward today admit they want to see the ooter die – 2:20 even if the jury decides to do life in prison or the death penalty phase, i believe i’ll be happy with either decision they hope when the trial ends… they can finally move on. prosecutors say phase three could last at least two more days. greg miller, krdo newschannel 13. a retired
