UPDATE: Victim preparing legal action in CSPD excessive force case
KRDO NewsChannel 13 has obtained a video that shows an incident at the center of an excessive force lawsuit being prepared against the Colorado Springs Police Department.
The surveillance video is from inside Memorial Hospital in November 2013 and appears to show an officer shoving a woman to the ground.
The Colorado Springs Independent identified the officer as Tyler Walker and the woman as Alexis Acker.
“It was so fast and so violent. It’s unlike anything I have ever seen in my career,” said Cindy Hyatt, Acker’s attorney. “The officer just lost it. He completely lost control of himself.”
One of two police reports obtained by The Independent said Acker kicked Walker in the groin area and that in response, the officer “rolled her out of the chair to the floor.” The other report says Walker “escorted Ms. Acker to the floor.”
“She’s handcuffed, so where is she going to go?” said Hyatt. “She is not going anywhere, she’s in a hospital. Any other 200-pound man seen doing something like that to a 100-pound, handcuffed woman would be arrested and charged.”
Acker’s civil attorney confirmed to KRDO NewsChannel 13 that in May, he filed a letter with the city indicating he is preparing a lawsuit. The Independent says Acker may seek as much as $500,000 in the suit. The letter reportedly says Acker suffered injuries to her face, head, teeth and jaw that have had long-term health consequences.
Colorado Springs Police Department spokesperson Lt. Catherine Buckley issued a statement about the video involving Acker:
“The video is part of civil litigation and an internal investigation therefore I am unable to provide comment.,” said Buckley in the statement. “Officer Walker is employed with the Colorado Springs Police Department.”
Hyatt said her client has been held accountable and she hopes Walker is, too.
“You don’t get a pass,” Hyatt said. “You don’t get to behave like this under these circumstances simply because you’re a police officer.”
