Theater shooting defense lawyers seek trial delay

Defense attorneys in the Colorado theater shooting case are requesting another delay in James Holmes’ trial, saying they don’t have enough time to prepare for the Jan. 20 start date.

In a motion released Friday, the attorneys asked to push the trial back two or three months. They cited the volume of evidence and demands of another case.

The judge didn’t immediately rule but asked prosecutors to respond Friday.

In another motion, defense lawyers said one of their witnesses won’t willingly testify because the trial will be televised. They asked the judge to reconsider TV coverage, but he refused.

Holmes pleaded not guilty by reason of insanity to charges of killing 12 people and injuring 70 in the 2012 attack at a Denver-area theater. Prosecutors are seeking the death penalty.
