Hearing to discuss photos in theater shooting case

Attorneys in the Colorado theater shooting case are heading to court to discuss what photo and video evidence can be shown at trial.

A hearing Tuesday will also address audio recordings and the storage of evidence that may be used during the trial of James Holmes. Holmes has pleaded not guilty by reason of insanity to charges of killing 12 people and injuring 70 in the July 20, 2012, attack at a Denver-area movie theater. Jury selection is expected to start in January.

Defense attorneys have asked a judge to bar photos that may be inflammatory, such as those showing dead or wounded victims. They say such photos would traumatize jurors and bias them against Holmes.

Prosecutors say those images are the best evidence of the crime.
