Judge sets new trial date for James Holmes

A Colorado judge has postponed the death penalty trial for movie theater shooter James Holmes for a fifth time.

Judge Carlos A. Samour wrote in a Monday ruling that jury selection will begin Jan. 20, after the defense asked for more time to review a sanity evaluation of Holmes. Jury selection had been set for Dec. 8.

Holmes has pleaded not guilty by reason of insanity to killing 12 people and injuring 70 in the July 2012 attack inside a Denver-area theater.

Holmes’ lawyers acknowledge he was the shooter but say he was gripped by a psychotic episode.

Prosecutors are seeking the death penalty.

The trial previously had been delayed in part over two sanity evaluations of Holmes.
