Defense: School may have withheld Holmes records

Defense attorneys in the Colorado theater shooting case say the University of Colorado might have withheld records that raise questions about how the school handled defendant James Holmes when he was a student there.

In documents made public Monday, Holmes’ lawyers said evidence from a prosecution witness led them to issue subpoenas for the university records. The witness’ name and specifics about the records were redacted.

A university spokesman had no immediate comment Tuesday. Lawyers in the case routine decline to comment, citing a gag order.

Holmes dropped out of a neuroscience program at the university shortly before the July 2012 attack, which killed 12 people and injured 70.

He pleaded not guilty by reason of insanity to murder and attempted murder charges. His trial is scheduled to start Dec. 8.
