Marijuana lawsuit challenges tax collections

Some marijuana activists in Colorado are suing over the collection of pot taxes.

A lawsuit filed in Denver District Court claims that collecting pot taxes violates the Fifth Amendment of the Constitution. That’s the protection from self-incrimination.

KUSA reports that the lawsuit says that when marijuana growers and sellers pay their taxes, they effectively incriminate themselves under federal law (http://on9news.tv/UrumgM).

Lawyer and prominent marijuana activist Rob Corry filed the suit and says that pot taxes are too high. He says the tax rate means the black market for marijuana persists.

A spokeswoman for the state attorney general called the lawsuit “bizarre.”
