Plea Deal Reached In Child Homicide Case
A plea bargain was reached Friday in the case against a Colorado Springs father convicted of killing his 8-month-old daughter.
Nicholas Patrick Smith agreed to plead guilty to child abuse resulting in death along with a sentence enhancement charge of violent crime causing death. In exchange, prosecutors dropped the original charge of first degree murder.
In December 2011, police responded to a call regarding an 8-month-old girl who was conscious and breathing but not alert. The baby, Elise Martinez-Mosley, was transported to Memorial Hospital. She died at the hospital the next day from blunt force head trauma.
Smith will be sentenced by a judge in August where he faces between 16 and 48 years in prison.
