Who Prosecutes Dougherty’s First?
There are several states that want to get the Dougherty Gang in their jails, so who gets them first?
All the agencies involved in Wednesday’s chase and capture will be meeting Friday with the Pueblo District Attorney to go over the facts in the case.
The recommended charges for the three are attempted murder for shooting at officers during the chase, D.A. Bill Thiebaut has to determine if they can prove it in court.
“We think the evidence shows, or we’re prepared to allege, that they were fired upon and their lives were put in danger,” he says, “and I think our community needs a chance in the justice system remedy that.”
But so does Florida, where the gang allegedly shot at an officer during another chase, maybe they’ll want to prosecute them first since that’s where the first crime was committed.
“The thing of it is, if we don’t have the evidence then we do understand that we need to get them to another jurisdiction,” says Thiebaut.
He also says there’s not really a rule on who gets the three first, but all the DA’s in the different county’s involved will negotiate an agreement.
