Hwy. 94 Crash Victim Identified, Other Driver Off Duty Deputy

Colorado State Patrol says the woman killed in a crash on Highway 94 and Curtis Road is 41-year-old Vivian Elmo from Colorado Springs.

Elmo was a military member assigned to the 310th Space Wing. She died at the scene of the crash at approximately 3:45 pm on Wednesday.

Highway 94 was closed for nearly four hours after the wreck.

Troopers say 42-year-old Rodney Fannin of Calhan hit Elmo’s car when he ran a red light.

Fannin was taken to the hospital with moderate injuries.

Target 13 has confirmed that Fannin is a deputy with the El Paso County Sheriff’s Office. He wasn’t on duty at the time of the crash and was in his personal vehicle. according to the El Paso County Sheriff’s Office.

Fannin has worked for the sheriff’s office for 9 years, and has been in trouble for traffic violations before.

Target 13 Investigates found two charges of careless driving, one in 2006 and the other in 2011. Fannin pleaded guilty to the 2011 charge and got a 6 month probation.

When Target 13 went to his home in Calhan to get his side of the story a woman said we were not welcomed and not to come back. When asked if Fannin had any comment she said, “no.”

Fannin has not been ticked for the fatal crash. The State Patrol said it was still under investigation. It doesn’t appear any drugs or alcohol played a role in the accident.

Sergeant Mike Schaller with the El Paso County Sheriff’s Office said upper management in the Sheriff’s Office was unaware of Fannin’s crash earlier this year because of a breakdown in communication.

“He reported this incident to his chain of command as required by Sheriff’s Office policy. Due to a breakdown in the notification process, the documentation was not forwarded to upper management. An administrative investigation about the circumstances surrounding that incident and the incident on August 3 has been initiated by the Sheriff’s Office.”

Shaller added, “The accident is currently under investigation by the Colorado State Patrol. The Sheriff’s Office does not anticipate any further information will be available until the conclusion of the State Patrol investigation and the Sheriff’s Office administrative investigation.”
