Affidavit Reveals New Details In AutoZone Shooting

A third arrest was made Wenesday in the shootings that took place at a Colorado Springs AutoZone in July.

Frani Olivas, also known as Frani Romero, was taken into custody and charged with accessory to first-degree murder.

In Olivas? affidavit, Dawn Morgan tells police that Olivas helped Ernest Schmidt devise a plan to rob somebody in order to get enough money to pay for an apartment.

According to the Affidavit, Morgan said she, Olivas and another woman, Linda Goad, dropped Schmidt off at the AutoZone.

Morgan, Schmidt?s wife, has been arrested and charged with being an accessory to first-degree murder. Ernest Schmidt is accused of shooting two men, killing one. Schmidt is also accused of kidnapping a third man.

Accorinding to the affidavit, during the kidnapping of the third man, Schmidt made several phone calls from the victim?s cellphone. Police say one of the calls was made to a number belonging to himself, and the other two calls were made to a number belonging to Olivas. Morgan said Olivas later destroyed the phone, and encouraged Schmidt to dispose of his weapon.

Morgan told police that Olivas purchased one wig and stole a second for Schmidt, the affidavit said.

According to the affidavit, Olivas denies having known Schmidt.

She does admit to picking the couple up early the next morning and taking them to a Motel 6.

Olivas told police it was Morgan who purchased the wig.

There was another woman who was with Olivas the night of the AutoZone shootings, according to the affidavit.

In the affidavit, Linda Goad said she was under the influence of drugs, but does remember Olivas telling here ?that the whole idea was not to hurt anybody it was to get some money because a gun scares people.? There is no arrest warrant for Goad.

On July 27, 39-year-old Joaquin Paniagua was shot and killed.

Donald Laroe, 54, told police he had gone inside the AutoZone to get a part for a vehicle he was working on. When he got back to his van, the suspect was in the back seat with a gun pointed at Laroe, police said. Laroe said the suspect demanded his cellphone and wallet, but Laroe refused. According to the affidavit, Laroe was shot once and then hit in the head with the pistol. Laroe was transported to the hospital where he had emergency surgery.

The third victim, Jose Luis Berrospe-Garcia, told police he was kidnapped at gunpoint but was uninjured. It was Garcia?s phone that Schmidt used to call Olivas the night of the shootings, police said.
