Kelsey Berreth’s daughter to stay with grandparents
UPDATE April 4: Another custody hearing took place Thursday, and Kelsey Berreth’s daughter will remain in the custody of Berreth’s parents.
Previous story, Feb. 7:
Kelsey Berreth’s parents have been granted custody, once again, of young Kaylee.
In court Thursday, Patrick Frazee was wearing a ballistic vest over his usual striped jumpsuit. Commander Greg Couch with the Teller County Sheriff’s office tells us there has been extra security taken to ensure Frazee’s safety.
“Our job is to protect everybody involved, including the defendant,” Commander Couch told KRDO.
His next hearing will be on April 4th at 8:30 A.M.
Patrick Frazee stands accused of murdering 29-year-old Berreth, who was last seen on Nov. 22 in Woodland Park. Her body hasn’t been found, but police believe she was murdered in her own home before being disposed of. Frazee faces charges of murder and solicitation to commit murder in the wake of her disappearance.
Their daughter, Kaylee, is safe and wasn’t injured. She was with Frazee up until when he was arrested on Dec. 21. Another custody hearing is set for 8:30 a.m. on April 4.
Frazee’s next court appearance for the murder charge is on Feb. 19. An alleged accomplice, Krystal Kenney, is set for a court appearance on Friday for a charge of tampering with evidence. She’s accused of disposing of Berreth’s cell phone, which was last pinged in Idaho.
Previous Story
Two court appearances this week could bring new information in the disappearance of Woodland Park mother Kelsey Berreth.
Berreth’s fiance and accused murderer, Patrick Frazee, will go before a judge for yet another custody hearing over the pair’s daughter, Kaylee, Thursday. The judge could give visitation rights to Frazee’s mom and sister.
It’s been more than two months since anyone has seen Kelsey, but there are still so many questions surrounding the case.
Krystal Lee Kenney, a nurse from Idaho is accused of disposing of evidence and is scheduled for a court appearance on Friday. Investigators believe she could be responsible for getting rid of Kelsey’s phone.
Berreth’s cell phone was last pinged in Gooding, Idaho, 700 miles away from Woodland Park, but only an hour from Kenney’s hometown.
New documents filed in Teller County court this week show that Kenney’s lawyers are asking for access to the evidence the state has against her.
Her lawyer lists nine demands with many of them focusing on getting access to evidence relevant to the case, so they can provide fair representation. That includes knowing who investigators have already spoken to. The court documents state it’s all to help her lawyers prepare for trial and avoid surprise.
But Criminal Defense Attorney Alex Berry says a plea may be Kenney’s best option.
“It’s more likely she’s doing a straight guilty plea. She may be willing to testify against Frazee and have reduced penalties because of that,” Berry said.
While we will have to wait until Friday for her case, we will find out more on Kaylee’s future Thursday.
