No criminal charges in Pueblo officer-involved shooting

The Pueblo District Attorney’s Office will not seek criminal charges in a deadly officer-involved shooting in Pueblo.

The shooting happened November 24, 2014. Jon Patrick Jaquez was shot and killed at the Loaf ‘N Jug on the 2100 block of East Fourth Street.

District Attorney Jeff Chostner released a report by the Critical Incident Team, detailing the incident and subsequent investigation.

The CIT found officer Michael Sincerbox and deputy Michael Hecht acted on the belief they and others were in danger of being severely injured or killed during the incident and therefore acted appropriately and within the law.

According to the report, the Pueblo County Sheriff’s Office had information that Jaquez was a drug dealer known to carry a concealed semiautomatic handgun. He had a felony arrest warrant for a burglary in Pueblo County. Jaquez was also a suspect in a drive-by shooting that happened November 9, 2014. It was believed that Jaquez was a threat to the safety of the community and that a plan should be developed to arrest him on the outstanding arrest warrant.

When law enforcement tried to locate and arrest Jaquez, he resisted and that is when he was shot, according to the report.

An autopsy was performed on Jaquez on November 26, 2014. It was determined the cause of death to be multiple gunshot wounds of the torso. Jaquez was shot nine times. The coroner also found Jaquez had amphetamine, methamphetamine, THC and morphine in his system.
