Lawyers arguing 2nd sanity evaluation for Holmes

Lawyers in the Colorado theater shooting case are back in court for a closed hearing centering on defendant James Holmes’ sanity.

Prosecutors and defense attorneys arrived Monday for arguments on whether Holmes should undergo a second sanity evaluation.

He pleaded not guilty by reason of insanity to charges of killing 12 people and injuring 70 at a Denver-area movie theater in 2012. Prosecutors are seeking the death penalty.

Holmes underwent a court-ordered sanity evaluation at the state hospital last summer. The conclusions haven’t been made public, but prosecutors claim the doctor who conducted the evaluation was biased. They’re asking for another evaluation by their own experts.

The judge barred victims, the public and the media from the hearing, saying the testimony could influence potential jurors.
