As Colo. recalls loom, legal wrangling continues

Colorado has never seen a recall election of state legislators and it has never seen the kind of elaborate legal wrangling next month’s recalls in El Paso and Pueblo counties have inspired.

A judge in Denver plans to wrap up arguments Thursday in the latest challenge to the recalls of Democratic Sens. Angela Giron and John Morse. The judge will decide a complaint from Colorado’s Libertarian Party, which argues electronic balloting is being improperly used in the Sept. 10 recalls.

The Libertarians believe that the electronic ballots sent to about 800 military and overseas ballots between the two Senate districts aren’t secure. Elections officials say the electronic ballots are secure and the only way to allow some to vote.

The ballot fight is the latest of many recall legal challenges.
