Colorado recalls see another legal challenge

Two state lawmakers who are facing the first legislative recalls in Colorado history are awaiting resolution of another legal challenge.

A Denver judge is scheduled to hear a complaint Monday that the recalls against Democratic Sens. Angela Giron and John Morse should be delayed. The state Libertarian Party and others are taking issue with a conflict in Colorado election law.

At issue is when candidates can qualify for ballots. The plaintiffs say the constitution gives them up to 15 days before the Sept. 10 elections. That’s an apparent conflict with earlier deadlines to get ballots printed and mailed to voters.

El Paso County elections officials say ballots have already been mailed to more than 600 military and overseas voters in Morse’s district.
