Defense: Don’t let reporter see Holmes’ notebook

Lawyers for Colorado theater shooting suspect James Holmes are objecting to a request by Fox News reporter Jana Winter to see a notebook Holmes sent to a psychiatrist before the shootings.

Holmes’ attorneys filed a motion Wednesday saying Winter has no legal grounds to see the notebook, which has been under seal.

Holmes’ attorneys have been trying for months to force Winter to disclose her confidential sources for a story reporting that the notebook contained violent drawings. Winter’s lawyers asked to see the notebook as part of their fight to keep her sources’ names secret.

Prosecutors also oppose allowing Winter’s lawyers to see the notebook.

Holmes is charged with killing 12 and injuring 70 in a Colorado movie theater in July. He has pleaded not guilty by reason of insanity.
