Holmes can wear civilian clothes at murder trial

Colorado theater shooting suspect James Holmes will be allowed to wear civilian clothing at his trial.

A judge’s order made public Tuesday granted a request from Holmes’ attorneys that he not be required to wear a jail uniform during the trial.

Holmes is accused of killing 12 people and injuring 70 in the July 20 shootings at a suburban Denver movie theater. He pleaded not guilty by reason of insanity to multiple counts of murder and attempted murder.

Prosecutors are seeking the death penalty.

The judge also granted the defense request to get a list of prospective jurors as far ahead of the trial as possible.

Holmes’ trial is scheduled to begin in February. He first must undergo a mental evaluation by state medical personnel.
